Abstract

In the Law of the European Union, art. 3.3 TUE points out that the EU aims to act «for the sustainable development of Europe based on a balanced economic growth […] in a highly competitive market social economy, tending towards full employment and social progress», and art itself. 147.2 TFEU states that, «To formulate and implement the policies and measures of the Union, the objective of a high level of employment must be taken into account». The purpose of the employment policy is to guarantee a quality job for the entire population, as recognized in Convention No. 122 of 1964, which is set out in its art. 1st, that every Member State must carry out an «active policy aimed at promoting full, productive and freely chosen employment»; and where the employment policy objectives are set as the guarantee of a job for all available people who are looking for it; that such work be as productive as possible; that there is freedom to choose the job and that each worker has the possibility of acquiring the necessary training to occupy the job that suits him and use in it the training and powers he possesses; that the impediments of access and permanence in employment be eliminated due to race, sex, religion, public opinion, national origin and social origin.
