Article 3 of Regulation (EC) 2201/2003 offers several alternative international jurisdiction forums based on the criterion of habitual residence and nationality. In this paper we will analyze how the criterion of the applicant's nationality influences the period of residence required for the courts of a Member State to be able to hear a divorce claim. Possession of the nationality of a Member State guarantees the existence of a real link with said Member State and it is perfectly legitimate to require the applicant a minimum period of habitual residence in the national territory of six months instead of one year.
