Abstract
The pre-order of digital content is the practice whereby the user acquires digital content in exchange for a price, but will not be able to enjoy it until a condition of pendency is met, generally the official release date. In the context of the supply of digital content, the lawmaker grants the entrepreneur the power to exempt the user’s right of withdrawal in order to protect copyright and the legitimate interests of third parties. In the light of market practice, this paper examines whether this exception should also be available to the entrepreneur in cases of advance supply, even if the risk of access to the content no longer serves as a basis.
