Abstract

The successive chain of economic and financial crises has prompted the accumulation in the balance sheets of credit institutions of a set of doubtful exposures that hinder their solvency and contribute to compromising their liquidity and consequently that of the system. In this scenario, the EU’s concern has been to promote a secondary credit market of this nature by regulating the assignment of credit portfolios and the securitization of said assets. This paper deals with a study of the current legal regime for the assignment of doubtful credit portfolios or NPLs, as well as the securitization operations of said distressed assets, through the analysis of recent community regulations.
