Resumo

This paper analyses the creation and development of the three-stage maritime delimitation method through the international judgements and arbitral awards recently delivered by the International Court of Justice, the International Tribunal for the Law of the Sea and the arbitral tribunals. According to this method, the first stage is the drawing of a provisional equidistant or median line; along the second stage, that provisional line may be adjusted whether there are relevant circumstances; finally, in the third stage the proportionality of the result is verified by means of the disproportionality test. The article concludes the advantages of this method as far as it is useful to achieve an equitable solution, highlighting the positive dialogue held between the international courts and tribunals.
