Zusammenfassung
Despite the incessant study on the rights doctrine not all agree with the definitions. The questions on fundamental rights are very important because they allow us to observe how it is failing on fundamental rights in prisons and try to find possible solutions. In this sense, the fundamentals of human rights, reflecting on the current situation in Spain and specifying which rights are fully respected and which breach, in some respects, in Spanish prisons are analyzed. They are subject to reflection collateral to prisoners from these rights and a brief reference to some fundamental civil and social rights of prisoners.
