Nuevas formas de manipulación del tacógrafo digital y su posible encuadre como delito de falsedad documental

Resumen

The use of the «tachograph» in some vehicles is an obligation that seeks to control the correct way of driving. The jurisprudence of the Supreme Court has established that the «digital tachograph» is an official document whose alteration can give rise to a crime of documentary falsification. This interpretation occurs on more traditional «tachograph» manipulation cases. However, in recent years new ways of manipulating the «digital tachograph» have been detected, which imply administrative sanctions and generate procedural problems. In this paper we will analyze three new methodologies, detected in daily practice, and we will discuss their possible incardination in some type of documentary falsification crime.
