Resumen

With the recent publication of Law 19/2013 on Transparency, Access to Public Information and Good Governance (LTBG) in Spain, the right of access to public information is subjugated to the scale of instrumental right developed from Artículo 105.b) of the Spanish Constitution (SC) and therefore removed from social reality, community and international parameters, and important constitutional premises with the damage and stagnation this implies. The right of access to public information reveals what is included in some fundamental rights that are essential in the Rule of Law, such as the freedom to be informed, a fundamental right set out in Article 20.1.d) of the SC. This study puts forward relevant doctrinal and jurisprudential positions that argue the tendency of this right in its aspiration to consecrate itself as a fundamental right and offers contrasting legal reasons that support this nature.
