Resumo
Currently, the overcriminalization is evident. In this paper I analyze, critically, the phenomenon of the expansion of the criminal law of socio-economic crimes and of the criminal law of traditional delinquency from the postulates of the social and democratic state of Law, under the hypothesis that the system of guarantees in one and the other of criminal Law is contrary, because the conditions of equality and proportionality are different.
