Abstract

Constitutional guarantee of penal legality principle has been seen considerably extended by constant, repeated precedents from the European Human Rights Court case-law on art. 7 of ECHR. Such a dissonance obliges Spanish Constitutional Court to adapt and leave clear the extent of the related fundamental right, as well as our courts to comply with such stance when interpreting and applying penal rule.
