Abstract

This Doctoral Thesis analyses article 112 of the Spanish Criminal Code in depth and proposes an interpretation in accordance with its private nature. To this end, this thesis studies the historical evolution of reparation in punitive jurisdiction, the differences between civil liability and criminal responsibility in accordance with the state-of-the-art, the model of civil liability ex delicto in our system and, finally, we analyse the abovementioned article 112 of the Spanish Criminal Code through a harmonious reading of all the hermeneutic methods.
