Abstract

The health emergency created by covid-19 has led to a shortage of medical resources for the care of the most seriously infected patients, with doctors having to choose for whom these resources are used. From the perspective and flexibility of the weighting criteria developed in the theories of the state of need, the aim is to provide tools for reflection that will allow medical decisions to be optimised in the application of existing resources. Likewise, these criteria serve the jurist to evaluate whether the medical decision taken is in accordance with the law. A brief excursus on the risks created by the lack of protective equipment with respect to the crime of denial of health care concludes this paper.
