Abstract

The article analyzes the parliamentary proceedings of 2015 that refers to release under supervision, which in its after-care mode expands the scope of crimes against life and those of gender and domestic violence, where what matters is not the criterion of dangerousness but the nature of the offenses. The return to the rigid dualism of classic cut that advocated the Project 2013, has failed to overcome the criticism. That is why the legal reform produces only a slight –but important– step toward the two-way process which intends the coexistence of penalties and security measures and its symbiotic application as a consequence of punitive reaction to the dan-gerous attributable.
